The Maryland Department of Agriculture has announced significant updates to the Maryland Prohibited Invasive Plant List, with new restrictions taking effect January 15, 2026. After this date, listed plants may not be added to stock or sold in Maryland.

What’s changing
Thirteen commonly sold ornamental plants including Callery pear, burning bush, Japanese barberry, nandina, invasive bamboos, privet, Scotch broom, and wisteria species have been added to the prohibited list. These plants are widely used in landscaping but pose documented risks to Maryland’s ecosystems.

Phase out timelines

• Potted plants must be phased out by January 15, 2027
• In ground plants must be phased out by January 15, 2028

After these deadlines, prohibited plants may no longer be in stock.

Important options for nurseries and dealers
Licensed nurseries, brokers, and plant dealers may request a one year extension to sell existing stock by submitting a written request to the Secretary of Agriculture and copying the Invasive Plants Advisory Committee.
Sterile or low risk cultivars may be eligible for exemption if they cannot hybridize, are clearly distinguishable, and have reduced environmental impacts.
